The business associate agreement

If your product handles protected health information for a health system, expect a BAA under 45 CFR 164.504(e). Required terms include that the business associate will "(A) Not use or further disclose the information other than as permitted or required by the contract or as required by law; (B) Use appropriate safeguards and comply, where applicable, with subpart C of this part with respect to electronic protected health information." Read the full section for the other required terms.

AI transparency asks

ONC's HTI-1 rule added decision support intervention criteria for certified health IT, 45 CFR 170.315(b)(11). For evidence-based and predictive decision support interventions, the Health IT Module must enable review of "source attributes" and "indicate when information is not available for review." This applies to certified health IT developers; a startup's model reaches it only if it is surfaced as a DSI through a certified EHR. Health systems may also reference the Coalition for Health AI, whose mission is "to advance the responsible development, deployment, and oversight of AI in healthcare" and which publishes an Applied Model Card.
